The U.S. Department of Justice has launched a lawsuit in federal court aimed at blocking the certification of Alaska’s U.S. Senate election results, which could impact the outcome if the incumbent Republican, Dan S. Sullivan, does not secure victory. The DOJ argues there may be “voter confusion” due to two candidates named Dan Sullivan on the ballot, potentially benefiting his Democratic rival, Mary Peltola.

In the forthcoming election on 3 November, Sen. Sullivan will be distinguished on the ballot as “(Registered Republican) Incumbent” to help voters differentiate between the candidates. Sullivan faces Peltola and another contender, Daniel J. Sullivan, a retired schoolteacher also running as a Republican.

Alaska employs ranked-choice voting, requiring candidates to secure at least 50% of the vote to win outright. Trump has condemned this voting method, labelling it a “scam” and urging Alaskans to support a measure to repeal it.

The Justice Department’s suit claims the election process may lack integrity if the election result hides true voter intent, given the similarity of the candidates’ names. Legal experts, however, suggest the chances of proving voter confusion are slim, as determining voters’ preferences post-election is practically unattainable.

This lawsuit follows a turbulent primary season, where the troubling dynamics of competing candidates named Sullivan raised concerns among both parties.

Should Peltola win, she would become the first Democrat to hold the Senate seat in nearly two decades.
